Fred Thompson's Disclosure Conundrum: Solved

As co-architect of McCain-Feingold-Thompson, the federal campaign finance reform legislation, would-be presidential candidate Fred Thompson has skirted the interstitial space between the Internal Revenue Service and the Federal Election Commission, using a mish-mash of competing laws to avoid disclosing his donors.

That ends on July 31, according to Thompson campaign sources. His "Friends of Fred Thompson Inc." plans to file form 8872 -- a schedule of contributions and expenditures -- with the IRS that day, which will give him leeway to formally announce his candidacy whenever he wants.

On June 4, Thompson's finance committee organized a 527 committee with the IRS after incorporating in Tennessee. Friends of Fred Thompson Inc." is a "testing-the-waters" committee, and regulations allow Thompson to raise and spend money to take the temperature of the electorate -- he can poll, he can travel to early primary states, he can hire a small staff.

If Thompson files with the FEC as a candidate, he'd lose the residuals he's paid by NBC for Law and Order. He'd also be a real candidate and there’d be pressure on him to "launch" his candidacy immediately. At the same time, if he files with the FEC before July 31, he gets an exemption from having to disclosure and contributors until October 15.

If he doesn't file with the FEC in July, his testing-the-waters committee is required to tell the IRS the identity of donors and the size of their donations about $500. If he's not raised that much, he could be embarrassed by a poor showing. If he’s raised a lot, it’s fodder, along with his own statements and language on his website, for a charge that his actions have lifted out of the testable waters and thrown him into the candidate ocean. That could cost him his residuals, too.

For example: his campaign website allows potential donors to sign up to make automatic monthly contributions. But testing the water candidates aren't allowed to line up seed money. Also: a legal disclaimer on his website cautions that contributions "will be used in connection with federal elections" and are "subject to the limits and prohibitions of federal law."

If the campaign does nothing -- if they fail to file as a federal candidate and fail to file form 8872 -- all contributions would be subject to a 35% tax and Thompson could be liable for civil penalties.

The politics of filing an FEC complaint over Thompson is sketchy, so don't expect any rival campaigns to bother.

But they'll watch the issue of residuals closely.

One scenario has Thompson waiting until the new season of Law and Order kicks off -- September -- before formally opening his campaign. But that would open him up to charges that he cares more about his Hollywood money than he does his presidential campaign.

Of course he is concerned about his residuals. He has a family. I feel certain he took that job knowing of the residuals and they made a difference.

He needs to meet with NBC and become a board member or advisor and have the residuals turned into fee's. NBC will go along unless they want to be on the bad side of a US President.

I am, and have been "with Fred". I think what his 527 committee is doing is strategically correct. Why? Look at all the other candidates who have declared early. They are, of necessity, spending like there is no tomorrow - and we are still over 15 months away from the election. This is insane, and no way to elect a President. I am for "testing the waters" as long as it can be done legally and ethically. I give a lot of credit to Fred's advisors.

I am leaning towards Fred Thompson, if he declares, and would like to know if he will support the "FAIR TAX"? He has indicated that he is in favor of Income Tax Reform, but that is a broad statement. Will he support the FAIR TAX? If he does, I think he will have a wind fall of supporters with the Fair Tax people, and I am one of them. Over 8,000 supporters showed up at the Fair Tax Rally in Columbia, S.C. and there are a lot more out there that I believe would support him, if he supports the Fair Tax. But, we need to know where he stands and will he support the FAIR TAX!!!!!!

See, that's the real problem...NOBODY knows where Fred stands. He's being so vague and indirect regarding every issue that nobody can get a feel for where he actually stands on the issues. Sure, Fred says we need to "Protect the border" and "Lower Taxes." That's all fine and dandy when it comes in a speech from the pulpit. But what America actually needs right now is somebody with A PLAN, (a good plan...sorry McCain, Ron Paul, and every Democrat) and the initiative to enact that plan.

His prolonged "Testing the Waters" committee is simply his way of manipulating the system to his own benefit.....because there is no way any argument will support his delays as benefiting the American voters. All the free media attention he's received as he's played around dipping his toes into political waters has taken valuable time away from candidates who are actually COMMITTED to the race, and developing agendas to help move America forward.

His approach has indicated what type of president he will be....SLOW TO ACT!!!

All I've ever heard Fred Thompson say is that we need to stop Al Queda, reform the tax code, and stop illegal immigration.

Any details on how you assume to do that Fred?

His talk simply sounds like a lazy old man sitting on his front porch talking about the weather and complaining about what is happening in Washington.

How many Neocons do we have to endure in the Republican primaries? Romney (Neocon), McCain (Neocon), Giuliani (Neocon), and now Fred Thompson (also Neocon!). Let's appreciate the miracle that a genuine conservative, Ron Paul, is set to rescue not only the Republican Party, but also our nation from the calamity of open borders and insane wars that these Neocons have perpetrated on our country.

If Ron Paul is a "genuine conservative", I'll stick with the Neocons, thank you very much.

This guy is a bigger RINO than McCain.

He cosponsors and champions campaign reform legislation. Then even before he declares he shrouds himself in the limits and loopholes of his own unconstitution law while the rest of conservatives and their issues have been punished by his lazy law.

This guy is too LAZY. He thinks campaigning for President is interviewing on talk-radio.

Fred already has had his residuals cut by NBC. He is not happy about that.
